Bipartisan members of Congress recently sent a blistering letter to the head of the Food and Drug Administration (FDA) complaining about the agency's response to their request to allow and regulate industrial hemp-derived CBD as a food additive. The lawmakers sought technical assistance from the FDA to advise on key provisions following the introduction of the CBD Product Safety and Standardization Act in December 2021. Bipartisan lawmakers want the FDA to respond within 30 days of receiving the letter and say the agency should at least provide enforcement guidance for the cannabinoid market. Under their bill, the FDA would be required to develop rules and hold a public comment period on the maximum amount of industrial hemp-derived CBD that can be added to each serving of food or beverage, labeling and packaging requirements, and "intended conditions of use.
